These Terms of Service ("Terms") govern your use of software development services provided by Thatpix Software Development LTDA ("Thatpix," "we," "us," or "our") to the client ("Client," "you," or "your"). By engaging our services, you agree to these Terms in their entirety.
All services will be outlined in a detailed Statement of Work (SOW) or contract, which will specify project scope, deliverables, timelines, and acceptance criteria. Changes to the scope must be documented in writing and may affect project timeline and costs.
Payment schedules will be specified in the project contract. Standard terms include a 50% deposit before work begins and the remaining balance upon project completion. We accept payments via bank transfer, credit/debit cards, and other methods as specified in the invoice.
Upon full payment, Client will receive ownership of the custom code created specifically for the project. Third-party components, libraries, or frameworks will remain subject to their respective licenses. Thatpix retains the right to use general concepts, programming techniques, and non-client-specific code for future projects.
Both parties agree to maintain the confidentiality of proprietary information shared during the project. This includes business strategies, technical specifications, and any sensitive data.
Client agrees to comply with all applicable laws and regulations related to the use of Thatpix services, including export control laws and international data privacy regulations. Thatpix services may not be used for illegal purposes or in violation of any applicable laws.

We collect information necessary to provide our services, including contact details, project requirements, and payment information. We may also collect usage data when you interact with our website or applications.
We use collected information to deliver and improve our services, communicate with clients, process payments, and comply with legal obligations. We do not sell personal information to third parties.
We implement appropriate security measures to protect your information from unauthorized access or disclosure. This includes encryption, access controls, and regular security assessments.

The initial project deposit (typically 50% of the total project cost) is non-refundable once work has begun, as it secures our resources for your project.
If a project is cancelled after work has begun, you will be invoiced for all work completed up to the cancellation date, based on our hourly rates or the percentage of completed deliverables.
If you believe that services were not delivered as agreed, please submit a detailed explanation of the issue within 14 days of delivery. We will review your claim and work with you to resolve any legitimate concerns in good faith.

Project timelines are outlined in the project contract or Statement of Work. We strive to meet all deadlines but cannot guarantee specific delivery dates as development timelines may be affected by various factors, including client feedback and change requests.
Deliverables will be provided via secure file transfer, code repository access, or direct deployment to the specified hosting environment as outlined in the project contract.
Upon delivery, clients have 14 days to review the deliverables and request reasonable revisions in accordance with the project specifications. After this period or upon client's written approval, the deliverables are considered accepted.

Clients may cancel services at any time by providing written notice. Payment obligations for work completed up to the cancellation date still apply, and the non-refundable deposit will be retained.
Thatpix reserves the right to cancel services in cases of contract breach, non-payment, or if required project information is not provided in a timely manner. In such cases, payment obligations for completed work remain in effect.
Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, pandemic, government restrictions, or internet service provider failures.
